Short answer: there is no single claim process that applies to every renters policy. The three policy forms we read share a core: report the loss, protect your belongings, list what was lost with supporting documents, cooperate with the insurer, and submit a sworn proof of loss when it is required. But the deadlines attached to those steps differ from form to form. This guide walks through the steps, shows where the forms diverge, and includes a checklist you can download or print.
What this guide covers
On October 27, 2026 we read the claim-related conditions of three policy forms:
- American Strategic Insurance Corp., form ASI HOR OK 09 21 (Oklahoma).
- Lemonade Insurance Company, form LEM 04 05 23, using the Colorado sample policy.
- Allstate, renters policy AS373 (Texas; the edition date is not shown).
We also read the NAIC’s page on filing a complaint and the Oklahoma Insurance Department’s complaint page. We could not open the Texas Department of Insurance or Colorado Division of Insurance complaint pages, so we say nothing about their procedures. Your policy, your insurer’s instructions and your state’s rules control. Anything we describe as a requirement is that form’s requirement only.
The steps, and what the forms say
- Protect the property. All three forms require reasonable steps to protect property from further damage and a record of what you spend on repairs. Allstate also asks you to separate damaged from undamaged property.
- Report theft to the police. The ASI form requires a police report describing all items stolen, submitted to the insurer. The Lemonade form requires notifying police for theft. The Allstate form says to report theft to the police as soon as possible.
- Notify the insurer. ASI says “immediate notice,” with a separate outer limit of one year after the date of loss for windstorm or hail. Lemonade says prompt notice. Allstate says promptly. We found no fixed number of days for the first notice in any of the three.
- Notify card issuers if a credit, debit or bank transfer card was lost or misused. All three forms say so.
- List what was lost. Each form asks for an inventory or detailed list of damaged or stolen property showing quantity, value and the amount of the loss (ASI and Lemonade also say description; Allstate says cost and actual cash value). ASI and Lemonade say to attach bills, receipts and related documents. Allstate asks for accounting records, bills, invoices and other vouchers that it reasonably requests.
- Keep receipts for extra living costs. All three forms ask for them if you are living elsewhere. See our guide on hotel stays and living expenses.
- Cooperate. Each form lets the insurer ask to see the damaged property and to request records. All three also let the insurer require examinations under oath.
- Submit a sworn proof of loss. See the next section; this is where the forms differ most.
The ASI, Lemonade and Allstate forms each say the insurer has no duty to provide coverage if you fail to comply with these duties and the failure to comply is “prejudicial to us.” We do not interpret that phrase; ask your insurer what it means for your claim.
Where the deadlines differ
| Provision | ASI HOR OK 09 21 (OK) | Lemonade LEM 04 05 23 (CO sample) | Allstate AS373 (TX) |
|---|---|---|---|
| Notice to insurer | Immediate notice; windstorm or hail no later than one year after the loss | Prompt notice | Promptly |
| Sworn proof of loss | Within 60 days after the insurer’s request | Within 60 days after the insurer’s request | Within 91 days after the loss |
| Insurer acknowledges the claim | — | — | By the 15th day after written notice of claim |
| Payment timing | Within 60 days after agreement or appraisal award; 30 days after final judgment | Payable 60 days after proof of loss is received and agreement, judgment or appraisal award | Within 5 business days after the insurer says it will pay |
| Time to sue | Two years after the date of loss | Base form: two years after the date of loss. The Colorado provisions replace it with three years after the cause of action accrues | Two years and one day from when the action first accrues |
A dash means we did not find a statement in the text we searched. The point of the table is not the exact numbers. Your policy and your state may set different ones, and a deadline that runs from the insurer’s request is a different thing from one that runs from the loss. Find the proof-of-loss and legal-action provisions in your own policy and write the dates down.
Renters insurance claim preparation checklist
General information, not advice. This checklist is built from duties found in three specific policy forms and from regulator guidance. Your policy may ask for more, less or something different, and its wording controls. Items marked “In the forms we read” appear in all three; items marked “Practical suggestion” do not come from those forms. Nothing you enter is sent or saved; it stays in this page unless you download or print it.
If you disagree with the insurer’s decision
The NAIC says to try to resolve the problem with your insurer first. If that does not work, your state insurance department can review eligible complaints, such as claim delays or denials, at no charge. The NAIC says most departments accept complaints online, by mail or by phone, and that an insurer cannot discriminate against you in the future for filing a complaint. It suggests gathering your policy number, documents, bills and records, keeping a record of your communications, writing a factual account with a timeline, using language from your policy where possible, and stating the outcome you want.
State processes differ. Oklahoma is one example: the Oklahoma Insurance Department says the company has twenty days from receipt of its letter to respond, and that the department cannot order a claim paid, decide fault, or determine the cause of loss, claim value or amount owed. It asks for copies of your policy, letters and phone logs. That description applies to Oklahoma only.
After a storm, a quake or another large event, see what three forms say about wind, hail and earthquakes, and a theft has its own police-report step.
